1. About these terms
These Terms of Service form an agreement between you and Gorilla Forms (“Gorilla Forms”, “we”, “us” or “our”) when you create an account or use gorillaforms.uk and its form-building, response-collection and payment-related features (the “Service”). If you use the Service for an organisation, you confirm that you have authority to accept these terms for that organisation.
2. Your account
You must provide accurate account information, keep your login details secure and tell us promptly if you believe your account has been compromised. You are responsible for activity carried out through your account unless it results from something for which we are legally responsible.
3. Your forms, content and respondents
You remain responsible for the forms you create, the questions you ask, the content you upload, how you promote a form and how you use the responses you receive. You must have all necessary rights and permissions for that content. You are also responsible for giving respondents any privacy information, notices or choices required by law and for handling their personal information lawfully. Our handling of personal information is explained in the Privacy Policy.
Gorilla Forms does not review or approve every form and is not responsible for promises, statements, products, services or transactions offered by a form owner.
4. Legal and acceptable use
You must comply with all laws, regulations, court orders, codes and licensing requirements that apply to you, your organisation, your forms, your respondents and your transactions.
You must not use the Service to:
- buy, sell, request, arrange or facilitate illegal goods, services or purchases;
- commit or encourage fraud, deception, money laundering, sanctions evasion or any other criminal activity;
- collect information without a lawful basis or appropriate notice;
- infringe another person’s intellectual property, privacy or other rights;
- send spam, distribute malware, interfere with the Service or attempt unauthorised access;
- publish content that is unlawful, threatening, abusive or deliberately misleading.
You are responsible for checking whether an item, service, payment or activity is lawful in every place where you make it available.
5. Subscriptions, free trials and billing
Gorilla Forms accounts use monthly plans. Each plan includes a maximum number of saved forms and a Gorilla AI generation allowance. Draft and published forms both count towards the form allowance. AI allowances operate over a rolling one-hour period. We may offer a complimentary account or a custom allowance, and an administrator may apply or remove those arrangements.
New paid subscriptions include a 14-day free trial. Stripe securely collects your authorised payment method when you start the trial, but the first monthly subscription payment is due only after the trial ends. Unless you cancel before the end of the trial, the selected monthly price will then be charged automatically and will continue monthly until cancellation. If you convert a complimentary account to a paid plan, Stripe will show the selected price and request payment authorisation; the first monthly payment is taken when checkout is completed and no additional free trial applies.
You can cancel during the trial or later from Billing in your account. A cancellation scheduled during the trial takes effect at the end of that trial, prevents the first subscription payment and leaves trial access available until then. A later cancellation normally takes effect at the end of the paid billing period, and payments already made are not automatically refundable except where required by law. Cancellation does not affect any statutory cancellation, refund or consumer rights that apply to you.
Stripe processes subscription payments and produces payment invoices. After each successful paid renewal, the related invoice is made available in the Billing section of your account. You are responsible for keeping your billing and contact information accurate.
If a payment fails or a subscription ends, we may restrict access to paid features while preserving access needed to manage billing or export information where reasonably practicable. If you move to a plan whose allowance is lower than your current usage, existing forms remain available but you may be unable to create or duplicate forms until your usage is within the new allowance or you select a larger plan. Plan features and prices may change on reasonable notice, subject to rights that cannot legally be excluded.
6. Payments collected through forms
Payment features connect form owners and respondents with independent payment providers such as PayPal or Stripe. Gorilla Forms is not a bank, payment processor, merchant of record, buyer, seller or party to a transaction between a form owner and a respondent.
You are responsible for the goods or services offered, prices, descriptions, delivery, refunds, cancellations, chargebacks, taxes, licences, customer service and legal compliance associated with your transactions. Your use of a payment provider is also governed by that provider’s terms and fees.
To the extent permitted by law, Gorilla Forms is not liable for payment-provider outages or decisions, declined or delayed payments, chargebacks, refunds, fraud, disputes between users, or the quality, safety, legality or delivery of anything bought or sold through a form. Nothing in these terms removes any responsibility that the law says we cannot exclude.
7. Availability and changes
We aim to provide a reliable Service, but we do not promise that it will always be available, uninterrupted or error-free. We may maintain, secure, improve, suspend or change parts of the Service. Where a change materially affects paid services, we will provide reasonable notice when practicable and respect rights that cannot legally be excluded.
Features using artificial intelligence may produce inaccurate or unsuitable material. You must review AI-generated content before publishing or relying on it.
8. Inactive forms and accounts
We reserve the right to archive or permanently remove forms and their associated responses where, during a continuous period of at least six months, you have neither logged into your account nor received a response on the relevant form. We may also close an account that has been inactive for that period if it has no recently active forms.
Where reasonably practicable, we will give notice using the email address on the account before permanent deletion. You are responsible for keeping that address current and exporting information you need to retain. Legal, security or technical circumstances may require removal without advance notice.
9. Suspension and removal
We may restrict, suspend or remove a form or account where we reasonably believe these terms or the law have been breached, the Service or another person is at risk, fees are overdue, or removal is required by a court, regulator or payment provider. Where appropriate, we will explain the reason and provide a reasonable opportunity to correct the issue or appeal.
10. Liability
You use the Service to create and operate your own forms. Gorilla Forms is not liable for your content, your relationship with respondents, your products or services, or losses caused by your failure to comply with these terms or applicable law.
We do not exclude or limit liability where doing so would be unlawful, including liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or your mandatory statutory rights. Subject to that, we are not liable for indirect or consequential loss, loss of profit, revenue, business, opportunity, goodwill or anticipated savings, or loss or corruption of data that you could reasonably have backed up.
For losses for which we are legally responsible, our total liability arising from the Service will not exceed £1. This cap does not apply where liability cannot legally be limited.
11. Ending your use
You may stop using the Service at any time. Stopping use or deleting forms does not by itself cancel a subscription; use the cancellation control in Billing. Provisions which by their nature should continue—including responsibilities concerning payments, content, liability and disputes—continue after an account or form is closed.
12. Changes to these terms
We may update these terms to reflect changes to the Service, law or our business. If a change is material, we will take reasonable steps to notify you. We may require you to accept a new version before continuing to use the Service. The version and effective date appear at the top of this page.
13. Governing law
These terms are governed by the laws of England and Wales. If you are a consumer, you keep any mandatory protections and rights to bring proceedings available under the laws of the part of the United Kingdom or other country where you live. If you use the Service wholly for business purposes, the courts of England and Wales have exclusive jurisdiction.
